1. General Provisions
These General Terms and Conditions of Sale apply to all product orders made on the website danarosejewelry.com. Placing an order implies full and unconditional acceptance of these terms, which outline the rights and obligations of both parties in the context of online sales of products and services offered by Dana Rose Jewelry. Any conflicting purchase conditions proposed by the Buyer will not be binding unless expressly accepted by the Seller (Dana Rose Jewelry).
These Terms and Conditions may be modified at any time and without notice. Any changes will apply to orders placed after the modification is published.
2. Product Offer
The available products and services are those listed on the site at the time of the Buyer’s visit, subject to stock availability. Product descriptions (photos, texts, features) are for informational purposes only.
If a product is unavailable after purchase, Dana Rose Jewelry will promptly notify the Buyer by email and offer either a refund or an exchange for a product of equal value, as preferred by the Buyer.
3. Pricing
All prices are listed in Swiss Francs (CHF) and do not include shipping fees. Shipping fees are added during checkout and shown in the order summary (“cart”). Once the order is confirmed, the price cannot be changed.
Dana Rose Jewelry reserves the right to change product prices at any time. Customs duties, import taxes, or other local/state charges may apply in some countries. These costs are the sole responsibility of the Buyer, including handling declarations and payments with the appropriate authorities. Buyers are encouraged to check with their local customs office for details.
4. Payment Methods
Purchases can be paid by credit card, TWINT, or PayPal. Full payment is required at the time of order confirmation when using any of these payment methods.
5. Shipping
Orders are shipped via standard postal service with tracking (no signature required). Products are delivered to the address provided at checkout, within the estimated delivery times indicated on each product page. These estimates do not include order preparation time, which Dana Rose Jewelry aims to minimize.

Once the Buyer physically receives the package, all risk of loss or damage transfers to the Buyer. It is the Buyer’s responsibility to inspect and notify the carrier of any damage or concerns.
If the Buyer does not collect the package within 7 days of attempted delivery, Dana Rose Jewelry reserves the right to cancel the order and recover the merchandise. If the order was prepaid, the Buyer will be refunded minus any return shipping costs. If the order was unpaid, the Buyer will be invoiced for return shipping.
6. Retention of Ownership
Unless otherwise specified by applicable law, Dana Rose Jewelry retains ownership of the products until full payment is received. See below for intellectual property rights.
7. Product Inspection
The Buyer must inspect the products within 24 hours of receipt and notify Dana Rose Jewelry of any defects or damage. If no notification is received within this timeframe, the products are considered accepted in good condition.
8. Warranty and Returns
Under the conditions specified in this policy, Dana Rose Jewelry offers a warranty covering items that do not match the order. Refunds or exchanges will be offered, subject to stock availability.

The warranty does not cover:
- Damage due to accidents or misuse
- Improper handling
- Normal wear and tear
The defective item must be returned within 7 days. Dana Rose Jewelry will reimburse shipping costs if the issue falls under warranty.
If the warranty is validated, Dana Rose Jewelry may choose to:
- Replace the defective item with an equivalent
- Offer a full refund based on the extent of the defect
No other returns will be accepted beyond these warranty cases.
9. Liability
Dana Rose Jewelry remains responsible for the goods until they are delivered. Once the Buyer receives the tracked shipment, responsibility for the items transfers to the Buyer.
10. Intellectual Property
All trademarks, domain names, product designs, software, images, videos, texts, and any other intellectual property remain the exclusive property of Dana Rose Jewelry.
No transfer of intellectual property rights occurs under these terms. Any full or partial reproduction, modification, or use for any purpose is strictly prohibited without prior written permission.
All illustrations are for personal use only. A special license must be requested for commercial usage.
11. Data Protection
Dana Rose Jewelry complies with applicable data protection laws. Only data necessary to process orders and billing will be collected and stored securely.
12. Governing Law and Jurisdiction
These terms and the relationship between Dana Rose Jewelry and the Buyer are governed by Swiss law. Any disputes will be settled under the jurisdiction of Dana Rose Jewelry’s registered office.
13. Force Majeure
Neither party will be held liable for failure to perform due to unforeseeable events beyond their control (force majeure). This includes—but is not limited to—natural disasters, strikes, supply chain disruptions, or governmental regulations.
The affected party must notify the other within 10 business days of becoming aware of the event. Both parties will then consult within one month to discuss how to proceed with contract performance.
If the force majeure event lasts more than three months, either party may terminate the agreement without penalty.
